Timothy Busfield files new motion to fight indictment in child sex abuse case

Actor Timothy Busfield is asking a court to throw out the indictment against him as he waits for trial on child sex abuse charges.

The West Wing star, 69, has pleaded not guilty to four charges involving a child under the age of 13.

The court documents state that Busfield's lawyers have asked a New Mexico court to dismiss the indictment. They claim prosecutors acted unfairly during the grand jury process that led to the charges.

His lawyer, Larry Stein, said jurors were not allowed to hear evidence, testimony and witnesses that could have helped Busfield's case. He also claimed prosecutors left out information that may have supported Busfield's innocence and gave incorrect explanations of the law.

Stein insisted Busfield is innocent and argued there is not enough evidence to prove the case at trial.

The charges were announced earlier this year by Bernalillo County District Attorney Sam Bregman. At the time, Bregman said Busfield should be considered innocent unless he is found guilty in court.

Prosecutors allege Busfield had unlawful sexual contact with 11-year-old twin boys. After police issued an arrest warrant, he turned himself in on January 13 and was later released while awaiting trial.

As part of his release conditions, Busfield cannot contact the alleged victims or their families, be alone with children, carry weapons, drink alcohol, use illegal drugs or discuss the case with witnesses.

Busfield has repeatedly denied the allegations and said he will continue fighting the case in court. A judge has not yet decided whether the indictment will be dismissed.
